Tencent Cloud Code Analysis Service Agreement

Welcome to use Tencent Cloud Code Analysis Service!

To use Tencent Cloud Code Analysis Service (hereinafter referred to as "TCA Service" or "this Service"), you shall read and comply with the "Tencent Cloud Code Analysis Service Agreement" (hereinafter referred to as "this Agreement"), Tencent Service Agreement, QQ Number Rules, WeChat Software License and Service Agreement, Tencent Privacy Policy, and [Tencent Cloud Code Analysis Privacy Policy](./Privacy Policy.html), and other relevant agreements. Please read and fully understand the terms carefully, especially clauses exempting or limiting liability, clauses on jurisdiction and applicable law, and terms in separate agreements for enabling or using specific services. Limitation and exemption clauses may be highlighted in bold.

Unless you have fully read, understood, and agreed to accept and comply with this Agreement, please do not use the TCA Service. Your confirmation via the web page or any other form of express or implied acceptance of this Agreement, or your use of the TCA Service in any manner, shall be deemed as your having read and agreed to be bound by this Agreement. This Agreement shall then take legal effect between you and Tencent Cloud Computing (Beijing) Co., Ltd. (hereinafter referred to as "Tencent") and become a legally binding document for both parties. If you do not agree to this Agreement, please immediately stop registering or using this Service.

This Service is not recommended for minors under 18 years of age. If you are a minor under 18, please read this Agreement and other above-mentioned agreements under the accompaniment of your parent or legal guardian, and pay special attention to terms related to minors.

If you have any opinions or suggestions regarding this Agreement or this Service, you may contact us through Tencent Customer Service, telephone customer service (4006 700 700), Tencent Customer Service WeChat Mini Program, Tencent Customer Service Official Account, etc. We will review the issues involved as soon as possible and respond to your request within the time limit specified by laws and regulations.

I. Scope of the Agreement

1.1 Scope of Application of the Agreement

This Agreement is entered into between you and Tencent regarding your registration, login, and use of this Service. A "User" refers to an organization or individual that registers, logs in, uses this Service, and obtains relevant usage and management permissions.

1.2 Relationship and Conflict Clauses of the Agreement

The content of this Agreement includes but is not limited to this Agreement and agreements, rules, and specifications related to this Service, as well as agreements, rules, and specifications that Tencent may publish from time to time regarding this Service. Once formally published, the foregoing content shall constitute an integral part of this Agreement, forming a unified whole, and you shall also comply with them: Tencent Service Agreement, QQ Number Rules, WeChat Software License and Service Agreement, Tencent Privacy Policy, and [Tencent Cloud Code Analysis Privacy Policy](./Privacy Policy.html), and other relevant agreements. In case of conflict between this Agreement and the foregoing content, this Agreement shall prevail.

II. User Information and Personal Information Protection

2.1 Protecting users' personal information is a basic principle of Tencent. Tencent will take reasonable measures to protect users' personal information. Tencent will collect, use, store, and share your personal information in accordance with this Agreement and the provisions of the [Tencent Cloud Code Analysis Privacy Policy](./Privacy Policy.html). For matters not explicitly specified in this Agreement regarding the protection of users' personal information, the content of the [Tencent Cloud Code Analysis Privacy Policy](./Privacy Policy.html) shall prevail.

2.2 Without your consent, Tencent will not disclose users' information to third parties, except as otherwise provided by laws and regulations or agreed in relevant agreements. Tencent will use various security technologies and procedures to establish a sound management system to protect users' information from unauthorized access, use, or disclosure.

2.3 You understand and agree that during the registration of an account or use of this Service, you may need to fill in certain necessary information, such as your name and mobile phone number, to provide account registration services or user identity verification. If there are special provisions in national laws, regulations, or policies, you need to fill in true identity information. If the information you fill in is incomplete, you will be unable to use this Service or may be restricted during use.

2.4 Generally, you can browse and modify the information you submit at any time. However, for the sake of security and identity verification (such as number appeal services), you may not be able to modify the initial registration information and other verification information provided during registration.

2.5 You agree to authorize Tencent to use your personal information for the following purposes:

(1) To perform TCA platform verification services;

(2) To perform TCA platform upgrade services;

(3) To enhance the security of your use of this Service or provide customer support;

(4) Because you selected or agreed during registration or enabling a certain service/function, or because you requested Tencent or a third party to provide specific services, Tencent needs to provide your relevant information to the associated third parties or other users;

(5) To use your nickname, avatar, and related operation information on the TCA platform, and to display such information to you or other users through Tencent services or services provided by third parties within Tencent services.

2.6 Tencent attaches great importance to the protection of minors' personal information. If you are a minor under 18 years of age, you should obtain the written consent of your parent or legal guardian before using this Service, and use it under the guardianship and guidance of your legal guardian.

III. Regarding This Service

3.1 Content of the Service

3.1.1 The TCA Platform refers to the Tencent Cloud Code Analysis system platform developed by Tencent and authorized for user use in accordance with this Agreement and other agreements and rules of Tencent.

3.1.2 The content of this Service is provided by Tencent to users through the TCA Platform, facilitating users to conduct code inspection, code measurement, continuous tracking and analysis of code, monitor project code quality, support teams in inheriting code culture, etc., for open-source or personal/team closed-source code repositories. The specific service content shall be subject to what is provided or displayed by the TCA Platform at the time, and users shall use this Service in accordance with this Agreement and relevant service rules.

3.2 Form of the Service

3.2.1 Users can enter the Tencent Cloud Code Analysis Website and complete registration and login using a QQ account or WeChat account in accordance with Tencent's relevant instructions to use this Service.

3.2.2 Users can use functions such as team management, project management, code repository management, analysis project management, tool management, solution template management, and message notifications through the TCA Platform, with specific capabilities subject to what the platform provides. You may use relevant services or functions according to your specific needs.

3.2.3 Users can create their own teams and send links to invite relevant personnel to join. Individuals who receive the invitation can join the corresponding team after completing registration as required by this Service. The team creator has team member permission management, team information modification, project management, and other team management permissions, with specifics subject to what the TCA Platform provides at the time.

3.2.4 You may be able to use this Service via web pages or Mini Programs on terminals such as computers and mobile phones. The service content provided may vary depending on the application environment, with specifics subject to what Tencent provides at the time. Additionally, Tencent has the right to continuously enrich the terminals and forms through which you use this Service based on actual circumstances. When using this Service, you should select the version of the Tencent Cloud Code Analysis system platform that matches your terminal and system; otherwise, you may be unable to use this Service normally.

3.2.5 You understand and agree that Tencent currently provides the TCA Platform for your free use, meaning you do not need to pay fees to Tencent to enable or use this Service. However, Tencent may charge fees for this Service in the future. Tencent may announce the charging methods and terms of this Service on the official TCA Service website through one or more means such as announcements, in-site notifications, text messages, and emails. If you still need to use this Service at that time, you shall pay fees in accordance with the charging methods and terms announced by Tencent, and comply with the service agreements, relevant rules, and specifications published by Tencent at that time; if you refuse to pay the fees for this Service at that time, Tencent has the right to no longer provide this Service to you.

3.3 License Scope of the Service

3.3.1 Tencent grants you a personal, non-transferable, and non-exclusive license to use this Service.

3.3.2 All other rights not expressly authorized by this clause or other clauses of this Agreement remain reserved by Tencent. You must obtain additional written permission from Tencent to exercise these rights. Tencent's failure to exercise any of the foregoing rights does not constitute a waiver of such rights.

3.4 Notes for Using the Service

3.4.1 You understand and agree that to provide you with effective service, after you register a code repository and initiate code analysis, the TCA Platform will pull your code for static analysis (i.e., it will not execute the code) during the analysis process, report issue line information (i.e., only issue lines identified during analysis will be reported, and no code block snippets will be reported) after analysis, and perform data cleanup. The TCA Platform will not retain your source code information.

3.4.2 You understand and agree that Tencent will make commercially reasonable efforts to ensure the security of your data storage on the TCA Platform and in the Service, but Tencent cannot provide absolute guarantees, including but not limited to the following scenarios:

3.4.2.1 Tencent is not responsible for the deletion or storage failure of your relevant data on the TCA Platform and in the Service;

3.4.2.2 Tencent has the right to independently determine the maximum storage period for individual users' data on the TCA Platform and in the Service, and allocate maximum data storage space for them on the server, based on actual circumstances.

3.4.2.3 If you voluntarily stop using the TCA Platform Service (e.g., by canceling your account) or if the Service is terminated or canceled due to violations of relevant laws and regulations, Tencent may permanently delete your data from the server. After the Service is stopped, terminated, or canceled, Tencent has no obligation to return any data to you. When our products or services cease operations, we will notify you through one or more means such as announcements, push notifications, text messages, and emails, and delete your data within a reasonable period, unless otherwise provided by laws and regulations.

3.4.3 You agree and understand that for any extended integrated tools, they are considered black boxes to the Tencent Cloud Code Analysis System, and Tencent Cloud Code Analysis System assumes no liability for such tools. Tencent Cloud Code Analysis System assumes no liability for tools independently extended and integrated by users or provided by open-source communities, with all related liabilities fully borne by the tool providers. Tools independently extended and integrated by users requiring review by the user. Such tools may include but are not limited to distributing analyzed code, which may result in information leakage, and this is unrelated to the Tencent Cloud Code Analysis System. Users are requested to conduct careful evaluations.

3.4.3.1 User Responsibilities: When using the Tencent Cloud Code Analysis System, users shall ensure compliance with relevant laws and regulations, and conduct careful evaluations of tools independently extended and integrated by users or provided by open-source communities. Users shall understand and agree that the Tencent Cloud Code Analysis System assumes no liability for users' use of such tools.

3.4.3.2 Tencent's Responsibilities: The Tencent Cloud Code Analysis System only provides code analysis functions and assumes no liability for users' use of tools independently extended and integrated by users or provided by open-source communities. The Tencent Cloud Code Analysis System only provides limited guarantees for code analysis results, with the specific scope of guarantees subject to the relevant service agreements of the Tencent Cloud Code Analysis System.

3.4.3 Tencent has the right to adjust or change the service system, service details, benefit details, service types (including free services, paid services, marketing activities, etc.), fee standards, and charging methods from time to time based on actual circumstances. Tencent will make every effort to notify you in advance through one or more means such as announcements, push notifications, text messages, and emails. If you do not agree to such adjustments and changes to the Service, you should stop using the Service.

3.4.4 You shall make your own judgments regarding the content on the TCA Platform and in the Service, and shall bear all risks that Tencent cannot control or reasonably foresee, including but not limited to:

3.4.4.1 Risks such as loss or leakage of personal information that may be caused by force majeure factors;

3.4.4.2 Risks and liabilities arising from modifications to collaborative configurations by others when working with others.

3.4.5 To improve user experience and ensure the security and consistency of service functions, Tencent has the right to update the Tencent Cloud Code Analysis System (these updates may take the form of system replacement, modification, function enhancement, version upgrades, etc.) or change or restrict the effects of certain functions of the Tencent Cloud Code Analysis System. After the new version of the Tencent Cloud Code Analysis System is released, older versions may no longer be usable. Tencent does not guarantee the continued availability of older versions or the continued provision of corresponding customer services. Please check and use the latest version at any time.

IV. User Rights and Obligations

4.1 Preparations for Using the Service

You need to prepare your own hardware devices required to receive this Service and activate internet connection services. Hardware costs and data traffic fees that may be incurred during the use of this Service shall be borne by you. If this Service cannot be used normally due to your lack of appropriate hardware or failure to successfully connect to the internet, Tencent assumes no liability.

4.2 Account Application and Use

4.2.1 Users shall submit clear and complete registration information as required by Tencent, including but not limited to basic information such as the user's name and mobile phone number, with specifics subject to the requirements of the TCA Service official website. If there are special provisions in national laws and regulations (the term "laws and regulations" in this Agreement refers to currently effective laws, administrative regulations, judicial interpretations, local regulations, local rules, departmental rules, and other normative documents of the region/country where the user is located, as well as any amendments and supplements to such laws and regulations from time to time, and relevant policy provisions, etc., the same below), you need to fill in true identity information (including but not limited to mobile phone number information).

You warrant that the information submitted is true, accurate, timely, and complete; otherwise, you may be unable to use this Service or may be restricted during use, and any direct or indirect disputes arising therefrom, as well as any liabilities or compensation resulting therefrom, shall be borne by you. You agree that Tencent may use methods such as mobile phone verification codes and emails for confirmation.

4.2.2 You may log in to and use this Service using a QQ account, WeChat account, or Enterprise WeChat account. Tencent has the right to change the account registration and login methods as needed for product requirements. For specific rules regarding your account usage, please refer to and comply with the QQ Number Rules and WeChat Software License and Service Agreement. If you violate the foregoing rules, you may be unable to log in to or use this Service.

4.2.3 You understand and undertake that the account you set up must not violate relevant national laws and regulations. The registered information of your account name, avatar, profile, and other personal information must not contain illegal or inappropriate content. You must not open an account using another person's name without authorization (including but not limited to impersonating another person's name, business name, trade name, avatar, or any other confusing means), nor may you maliciously register accounts (including but not limited to frequently registering accounts, batch registering accounts, or registering more than a reasonable number of accounts using the same identity). You must comply with relevant laws and regulations during account registration and use, and must not engage in any acts that harm national interests, infringe upon the legitimate rights and interests of other citizens, or violate social ethics. Tencent has the right to review the information you submit.

4.2.4 The ownership of TCA service accounts belongs to Tencent. After completing the account registration procedures, users only obtain the right to use the TCA service account, and this right of use belongs solely to the initial applicant. Users shall not gift, lend, rent, transfer, or sell TCA service accounts, or permit others to use TCA service accounts in any other manner. Non-initial applicants shall not use TCA service accounts through gifting, inheritance, leasing, assignment, or any other means. Otherwise, Tencent has the right to take disposal measures including but not limited to unilaterally terminating the Service, restricting/disabling partial functions, or banning TCA service accounts, without refunding any fees you have paid. Any temporary or permanent inability to use partial/all functions or the TCA Service due to this shall be borne by you. Moreover, if this causes losses to Tencent, you shall compensate for them.

4.2.5 Users must comply with this Agreement, agreements on cooperation with Tencent signed by the user, and special rules issued by Tencent for this purpose (if any) when using TCA service accounts. Users must not violate the foregoing agreements and rules to use their TCA service accounts for other purposes. Otherwise, Tencent has the right to restrict, suspend, or terminate the provision of this Service to you at any time, and you must not use this Service again without Tencent's consent.

4.2.6 Your TCA service account is your credential for logging in and using this Service. You shall take confidentiality measures for your account and password. Any losses or consequences arising from the loss or disclosure of such accounts, passwords, etc., due to inadequate confidentiality measures or other actions on your part shall be borne solely by you.

4.2.7 You shall reasonably set the management permissions of relevant personnel, remind or require members of your organization or team to pay attention to information security and account security, and prevent account misuse leading to information leakage. You warrant that you bear all responsibilities for the actions of yourself, your authorized, or designated personnel in using the account and password. If you choose to join a team, it is deemed that you accept the management of the team you belong to, and the team project data you submit is controlled and managed by the team you belong to. You must exercise relevant permissions in accordance with the authorization of the team you belong to.

4.2.8 If you discover that someone else is using your account and password without authorization, or any other unauthorized use occurs, you shall immediately notify Tencent through effective means (including but not limited to providing your true identity information and relevant identity materials, relevant facts, and your requirements). After receiving your valid request and verifying your identity, Tencent will take corresponding measures based on different circumstances. If you provide incomplete information, resulting in Tencent's inability to verify your identity or determine your needs, and thus Tencent is unable to handle the matter in a timely manner, any losses incurred shall be borne by you. Additionally, you understand and agree that Tencent requires a reasonable period to take measures in response to your request. Tencent assumes no liability for any losses caused to you by the actions of others.

4.2.9 You understand and agree that when registering for an account or using Tencent services, if Tencent detects that your account may be involved in fraud or poses risks, Tencent has the right to re-verify your account and, based on the level of risk, take measures such as requiring corrections within a time limit, restricting functions, suspending use, closing the account, prohibiting re-registration, and other disposal measures specified in this Agreement.

4.2.10 During the process of providing services to you, if Tencent discovers clues or information about fraud-related illegal or criminal activities, Tencent has the right to transfer the matter to the relevant departments with authority, such as public security, finance, telecommunications, and cyberspace administration, in accordance with national regulations, based on the type and severity of the fraud risk.

4.3 User Conduct Standards

4.3.1 When using the TCA Service and related services, you must comply with relevant laws and regulations and service rules, and ensure that you have the business qualifications and capabilities required by laws and regulations. You must not engage in any of the following acts, nor facilitate any acts that violate laws and regulations:

4.3.1.1 Opposing the basic principles established by the Constitution.

4.3.1.2 Endangering national security, leaking state secrets, subverting state power, or undermining national unity.

4.3.1.3 Harming national honor and interests.

4.3.1.4 Inciting ethnic hatred or discrimination, or undermining ethnic unity.

4.3.1.5 Undermining national religious policies, or promoting cults and feudal superstitions.

4.3.1.6 Spreading rumors, disrupting social order, or undermining social stability.

4.3.1.7 Spreading obscene, pornographic, gambling, violent, murderous, terrorist, or inciting criminal content.

4.3.1.8 Insulting or defaming others, or infringing upon the legitimate rights and interests of others.

4.3.1.9 Engaging in any act that violates the "Seven Bottom Lines."

4.3.1.10 Containing other content prohibited by laws or administrative regulations.

4.3.2 When using the TCA Service and related services, you must safeguard internet order and security, must not infringe upon the legitimate rights and interests of any entity, and must not engage in any of the following acts, nor facilitate such acts:

4.3.2.1 Engaging in fraudulent, false, or misleading acts, or infringing upon the intellectual property rights or other legitimate rights and interests of others, such as "private servers" or "cheat tools."

4.3.2.2 Publishing or disseminating spam (SPAM) or information containing content that endangers national order and security, promotes feudal superstitions, obscenity, pornography, vulgarity, or other illegal or regulatory violations.

4.3.2.3 Violating the operational regulations of networks, devices, or services connected to the TCA network; engaging in illegal or unauthorized access, theft, interference, or monitoring.

4.3.2.4 Engaging in any act that disrupts or attempts to disrupt network security, including but not limited to maliciously scanning websites or servers, illegally intruding into systems, or illegally obtaining data through viruses, Trojans, malicious code, phishing, or other means.

4.3.2.5 Engaging in any act that alters or attempts to alter the system configurations provided by the TCA Service or disrupts system security; using technical or other means to disrupt or interfere with the operation of the TCA Service or others' use of the TCA Service; interfering with or attempting to interfere with the normal operation of any part or function of the TCA Service in any way, or creating, publishing, or disseminating tools or methods for such purposes.

4.3.2.6 Engaging in any business (including but not limited to "DNS resolution," "security services," "domain name agency," "reverse proxy," etc.) that causes you to frequently suffer attacks (including but not limited to DDoS attacks) and failing to rectify the behavior in a timely manner or eliminate the impact as required by Tencent, thereby affecting the TCA Service or others.

4.3.2.7 Engaging in other acts that disrupt internet order and security.

4.3.3 Without the written permission of Tencent, you shall not, on your own or by authorizing, permitting, or assisting any third party, engage in the following acts regarding the TCA Service and related information content:

4.3.2.1 Replicating, reading, or using the TCA Service or information content for commercial purposes other than those agreed upon in this Agreement;

4.3.2.2 Unauthorized editing, organizing, or arranging the information content of the TCA Service platform and related services for display through channels other than the source pages of the TCA Service and related services;

4.3.2.3 Using improper means to guide, transfer, hijack, or engage in any other acts that have an adverse effect on the TCA Service and related services, either on your own or by assisting third parties;

4.2.2.4 Except as expressly permitted by Tencent, you shall not modify, translate, adapt, rent, sublicense, distribute over information networks, or transfer the services or software provided by Tencent, nor reverse engineer, decompile, or attempt to discover the source code of the services or software provided by Tencent;

4.2.2.5 Other acts prohibited by Tencent.

4.4 Taking Responsibility for Your Own Actions

4.4.1 Users fully understand and agree that they shall properly safeguard their TCA service accounts, passwords/keys (including but not limited to API interface secrets). Without the prior written consent of Tencent, they shall not transfer or authorize others to use such accounts, keys, etc., and shall bear full responsibility for all activities conducted through their accounts. Losses or damages caused by the loss or improper safekeeping of accounts, passwords/keys shall be borne independently by you.

4.4.2 Users must take responsibility for all actions under their registered accounts, shall make their own judgments regarding their behavior when using this Service, and shall bear all risks arising from improper use of this Service, including but not limited to issues such as modifying team or project information, altering code analysis configuration information, changing code repository credential information, and inviting other members leading to code leakage. Tencent cannot and will not be liable for any losses or damages resulting from the foregoing risks.

4.4.3 You shall take necessary security protection measures for the computer information systems and devices you use in accordance with national regulations and your own needs, including but not limited to installing computer information system security special products licensed by the state. You shall not install or use pirated software on the TCA Service or platform; you shall bear full responsibility for the consequences arising from your actions (e.g., self-installed software and operations).

4.5 Handling Breaches of Contract

4.5.1 If Tencent discovers, receives complaints from others, or is notified by regulatory authorities in accordance with the law that you have violated the terms of this Agreement or relevant laws and regulations, Tencent has the right to unilaterally take one or more of the following measures based on the specific circumstances (the duration of each measure shall be determined by Tencent based on the circumstances of your violation):

4.5.1.1 Deleting, blocking, or disconnecting links to relevant content at any time without prior notice;

4.5.1.2 Issuing warnings to you;

4.5.1.3 Restricting or prohibiting your use of partial or all functions;

4.5.1.4 Suspending or terminating your use of the relevant TCA service account;

4.5.1.5 Announcing the results of the handling;

4.5.1.6 Taking other reasonable and lawful measures;

4.5.1.7 Pursuing your legal liability in accordance with the law.

4.5.2 You understand and agree that Tencent has the right to impose penalties on acts that violate relevant laws and regulations or this Agreement based on reasonable judgment, take appropriate legal actions against any user who violates laws or regulations, and preserve relevant information, report to relevant authorities, and cooperate with investigations as required by laws and regulations or regulatory authorities. You shall bear all legal liabilities arising therefrom independently.

4.5.3 You understand and agree that if any third party claims compensation or asserts demands against you due to your violation of this Agreement or relevant service terms, you shall bear independent liability; if Tencent incurs losses as a result, you shall also compensate for them.

4.6 Handling Damage to Third Parties

4.6.1 If a third-party institution or individual raises questions or complaints against you, Tencent will notify you, and you have the responsibility to provide explanations and supporting materials within the specified time. If you fail to provide counter-evidence or fail to provide them within the time limit, Tencent has the right to take corresponding handling measures. Failure to contact you due to your failure to update your contact information in a timely manner or providing incorrect contact information shall also be deemed as your failure to provide feedback within the time limit.

4.6.2 If you violate the agreement and cause damage to any third party, you shall bear independent liability; if Tencent incurs losses as a result, you shall also compensate for them.

V. Tencent's Rights and Obligations

5.1 Tencent will activate this Service for you in accordance with relevant agreements after you submit information for registration. If the information you provide is incomplete, does not comply with this Agreement or agreements, rules, and specifications related to this Service, or violates national laws and regulations or has special provisions under policies, Tencent has the right to refuse to activate this Service and cancel your eligibility to use it, and Tencent assumes no legal liability therefor.

5.2 Tencent will provide you with clear operational guidance services and offer technical consulting services when service issues arise or when you operate incorrectly.

5.3 You have the right to submit opinions or suggestions to Tencent regarding service quality issues, and Tencent will respond as soon as possible. If the issue can be resolved in a timely manner, Tencent will assist you in resolving the relevant issue promptly.

5.4 When there are changes to the functions or usage methods of this Service, Tencent will notify users through the notification methods agreed upon in this Agreement.

VI. User Business Data

6.1 You warrant that the user business data you store or upload to the TCA Service is data that you have collected, obtained, or generated in accordance with the law, and that you have not and will not infringe upon the legitimate rights of any individual or entity in any way. You also understand that information and data recorded by Tencent due to your use of this Service, such as log information, measurement and cost information, and service consultation information, are subject to Tencent's corresponding rights.

6.2 You warrant that you have the right to use the TCA Service to store, upload, analyze, distribute, or otherwise process the foregoing user business data, and that such processing activities comply with relevant laws and regulations, do not involve any illegal, infringing, or breach of contract with third parties, and will not use the data for illegal or regulatory violations.

6.3 You have the right to use the TCA Service to upload, analyze, delete, modify, or otherwise process user business data (subject to the service rules of the specific service you use). For data deletion, modification, and other processing, you shall operate with caution and bear the consequences arising from such operations. Once user business data is deleted, it cannot be recovered, and you shall bear the consequences and liabilities arising from the deletion of such data. You understand and agree that Tencent has no obligation to continue retaining, exporting, or returning user business data.

6.4 Except for what is necessary for your use of the TCA Service and as otherwise provided by laws and regulations, the TCA will not access or use your user business data without your consent. The following situations are exceptions:

6.4.1 When a state organ lawfully queries or accesses user business data, Tencent has the obligation to cooperate in accordance with relevant laws, regulations, or policy documents and disclose the data to third parties or administrative and judicial authorities;

6.4.2 When you and Tencent reach a separate agreement.

6.5 Tencent has the right to terminate the provision of all or part of the Service to you at any time due to any violations of laws and regulations, relevant legal provisions, or requests from competent authorities related to the generation, collection, processing, or use of your data. All losses incurred by you or liabilities and expenses assumed by you due to this shall be borne by you independently.

6.6 Except as explicitly agreed by laws and regulations, required by competent authorities, or otherwise agreed by both parties, the TCA will no longer retain any of your user business data under the following circumstances, including deleting all cached or backup copies:

6.6.1 When the service period expires, the Service is terminated in advance (including but not limited to termination upon mutual agreement, termination due to other reasons, etc.), or you have arrears exceeding 6 months;

6.6.2 When your account has been banned or reclaimed;

6.6.3 When you violate this Agreement, relevant laws and regulations, or as required by competent authorities.

VII. Intellectual Property Rights

7.1 Tencent is the owner of the intellectual property rights of the TCA Platform. Intellectual property rights such as copyrights, trademarks, patents, and trade secrets of the TCA Platform, as well as all information content related to the TCA Platform (including but not limited to text, images, audio, video, charts, interface designs, layout frameworks, relevant data, or electronic documents), are protected by laws and regulations and relevant international treaties. Tencent lawfully enjoys the foregoing intellectual property rights, except for rights that should be enjoyed by relevant right holders in accordance with legal provisions.

7.2 Trademark rights, copyrights, or other intellectual property rights enjoyed by both parties shall remain the sole property of each party and will not be transferred to the other party or jointly owned by both parties due to the conclusion or performance of this Agreement.

Without the written authorization of Tencent or relevant right holders, you have no right to copy, distribute, transfer, license, or provide others with the use of the foregoing intellectual property rights.

You agree and authorize Tencent to use your name, brand, trademark logo, etc., as commercial cases for publicity and display.

7.3 Both parties shall respect the intellectual property rights of the other party and third parties. Without the consent of the right holder, neither party may reverse engineer, decompile, disassemble, crack, or make any form of modification to software or systems. If any third party initiates litigation or claims compensation against the other party due to the infringement of its intellectual property rights or other legitimate rights and interests by one party, the responsible party shall independently handle the relevant disputes, compensate the other party for direct economic losses, and indemnify the other party from liability.

VIII. Confidential Information

8.1 For the purposes of this Agreement, both parties have already provided or will provide or disclose certain confidential information. The party disclosing the confidential information is referred to as the "Disclosing Party," and the party receiving the confidential information is referred to as the "Receiving Party."

8.2 "Confidential Information" refers to non-public information, data, materials, etc., related to the Disclosing Party's business, operations, technology, rights, and other matters held by the Disclosing Party, including but not limited to business plans, commercial materials, technical knowledge and information, creative ideas, concepts, plans, provided items or vendor information, user information, personnel information, business plans, service prices and discounts, financial conditions, etc.

8.3 The Receiving Party shall keep the Disclosing Party's confidential information confidential if it becomes aware of such information from the Disclosing Party and such information is marked or can be reasonably deemed to be the Disclosing Party's confidential information. The Receiving Party shall not disclose such information to third parties or use it for purposes other than this Agreement without the prior written consent of the Disclosing Party. The Receiving Party shall treat the Disclosing Party's confidential information with the same degree of care as it would treat its own confidential information (and shall not be less than a reasonable standard of care).

8.4 Notwithstanding the foregoing, information shall not be deemed confidential information if it falls under any of the following circumstances:

8.4.1 The Receiving Party already lawfully holds the information through legitimate channels or means before the Disclosing Party discloses it to them;

8.4.2 The information has entered the public domain or has been made public without fault on the part of the Receiving Party;

8.4.3 The Receiving Party lawfully becomes aware of the information from another third party with the right to disclose such information and has no obligation of confidentiality;

8.4.4 The Receiving Party independently obtains or develops the information without using or referencing any of the Disclosing Party's confidential information.

8.5 If the Receiving Party needs to disclose the Disclosing Party's confidential information in accordance with laws or regulatory authorities' requirements, this shall not be deemed a breach of this Agreement. However, the Receiving Party shall notify the Disclosing Party as soon as possible within the scope permitted by law and shall make efforts to help the Disclosing Party effectively limit the scope of disclosure of such confidential information and protect the Disclosing Party's legitimate rights and interests.

8.6 The confidentiality obligations of both parties shall remain valid during the term of this Agreement and after its expiration until the relevant information no longer has confidentiality implications.

8.7 In the event of a breach of confidential information, both parties shall cooperate to take all reasonable measures to avoid or mitigate the consequences of the damage; if the Receiving Party breaches its confidentiality obligations and causes losses to the Disclosing Party, the Receiving Party shall compensate the Disclosing Party for the direct economic losses incurred.

IX. Third-Party Technologies or Services

9.1 This Service may use third-party software or technologies (including open-source code and public domain code that this Service may use, the same below), and such use has been lawfully authorized.

9.2 If this Service uses third-party software or technologies, Tencent will, in accordance with relevant laws or agreements, display the relevant agreements or other documents through appendices to this Agreement, by packaging them in specific folders within the Service installation package, etc. These agreements or other documents may also be presented in the form of "Software License Agreements," "Authorization Agreements," "Open-Source Code Licenses," or other forms. The foregoing agreements or other documents presented in various forms are integral parts of this Agreement and have equal legal effect with this Agreement. You shall comply with these requirements. If you fail to comply with these requirements, the third party or state organs may initiate litigation, impose fines, or take other sanctions against you and request assistance from Tencent, and you shall bear legal liability independently.

9.3 If any dispute arises from the third-party software or technologies used by this Service, the third party shall be responsible for resolving it, and Tencent assumes no liability. Tencent does not provide customer support for third-party software or technologies. If you need to obtain support, please contact the third party.

X. Service Changes, Suspension, or Termination

10.1 You understand and agree that due to adjustments in Tencent's business strategy or changes in national major technologies, regulations, or policies, Tencent has the right to change, suspend, or terminate this Service. Tencent will make every effort to notify you in advance through one or more means such as push notifications, announcements, text messages, and emails, and will allow a reasonable period of time for you to properly handle your data. If this causes you losses, you agree to waive your right to pursue liability against Tencent.

10.2 You understand and agree that if other suspension or termination conditions agreed upon in this Agreement occur or are met, Tencent has the right to suspend or terminate the provision of all or part of this Service to you at any time.

10.3 You understand and agree that unless otherwise agreed in this Agreement, if this Agreement or this Service is terminated for any reason, Tencent may retain or delete all information in your account or any data stored on Tencent's servers due to your use of this Service, including any incomplete data before the Service termination, and will provide you with a reasonable period to complete data downloads and backups. You agree not to pursue any liability against Tencent or assert any rights against Tencent.

XI. Disclaimer Clauses

11.1 You understand and agree that due to the special nature of network services or adjustments and changes in national policies or industry regulations, Tencent has the right to change, suspend, or terminate part or all of the Service based on the overall operation of the Service or relevant operational norms and rules. Tencent will notify users through the notification methods agreed upon in this Agreement.

11.2 You understand and agree that to provide you with better services, Tencent has the right to periodically or irregularly inspect, maintain, upgrade, etc., the platforms or related equipment providing this Service. Such actions may cause interruptions or suspensions of the relevant Service for a reasonable period of time. Tencent will notify you in advance through one or more means such as push notifications and announcements on the website as much as possible to facilitate your business arrangements. If this causes you losses, you agree to waive your right to pursue liability against Tencent.

11.3 You understand and agree that Tencent's Service is provided in its current state, which represents the level of technology and conditions achievable. Tencent will make every effort to provide you with services and ensure the continuity and security of the Service; however, Tencent cannot guarantee that the Service provided is flawless, nor can it foresee and prevent legal, technical, or other risks at any time, including but not limited to service interruptions, data loss, and other losses and risks that may be caused by force majeure, viruses, Trojans, hacker attacks, system instability, communication line failures, third-party service defects, government actions, etc. Therefore, you also agree that even if there are defects in the Service provided by Tencent, such defects are unavoidable given the technical level of the industry at the time and shall not be deemed a breach of contract by Tencent. Additionally, you agree to waive your right to pursue liability against Tencent for any data or information losses caused thereby.

11.4 You understand and agree that if the Service is interrupted or obstructed due to the following circumstances, Tencent assumes no legal liability:

11.5.1 Damage caused by computer viruses, Trojans, or other malicious programs, or hacker attacks;

11.5.2 Malfunctions in your computer software, system, hardware, or communication lines;

11.5.3 Improper operation by you;

11.5.4 Your use of this Service through non-Tencent-authorized means;

11.5.5 Other circumstances that Tencent cannot control or reasonably foresee.

XII. Regarding Notifications

12.1 You shall guarantee and maintain the validity of your user information (including but not limited to telephone numbers, email addresses, and other contact information). If your user information is false or invalid, or may otherwise prevent you from timely receiving business notifications, service prompts, customer service, technical support, dispute resolution, violation penalties, etc., you shall bear the corresponding liabilities.

12.2 Tencent may deliver various rules, notifications, prompts, and other information regarding this Service to you through one or more means such as web page announcements, web page prompts, emails, text messages, regular mailings, and in-site messages sent within the management system of your registered Service account. Once Tencent publishes or sends such information through any of the foregoing means, it shall be deemed that you have accepted and agreed to it, and it shall be binding on you. If you do not accept this, please notify Tencent in writing; otherwise, it shall be deemed that you have accepted and agreed.

12.3 If you have matters to notify Tencent, you shall notify Tencent in writing through the officially published contact information of this Service.

XIII. Provisions for Minor Users

13.1 We attach great importance to the protection of minors. Our product, as a code analysis tool, does not actively target minors as a user group, nor can it identify whether a user is a minor through the use of the TCA Service. Therefore, if a user is under 18 years of age, they should proactively request to read this Agreement and use this Service under the guardianship and guidance of their parent or legal guardian.

13.2 Minor users should pay attention to the following matters when using this Service to enhance their safety awareness and self-protection:

(1) Recognize the difference between the online world and the real world, avoid becoming addicted to the internet, and affecting daily study and life;

(2) Strengthen personal protection awareness when performing any operational configuration data information during the use of this Service to avoid harassment of personal life by bad actors;

(3) Learn to use the internet correctly under the guidance of parents or teachers;

13.3 Guardians and schools should provide more guidance to minors when they use this Service. In particular, parents should care about their children's growth, pay attention to communication with their children, and guide their children on safety issues to be aware of when going online to prevent problems before they occur.

XIV. Applicable Law and Dispute Resolution

14.1 The place of signing of this Agreement is Nanshan District, Shenzhen City, Guangdong Province, People's Republic of China.

14.2 The conclusion, effectiveness, performance, interpretation, and dispute resolution of this Agreement shall be governed by the laws of mainland China (excluding conflict of laws).

14.3 If any dispute or controversy arises between you and Tencent, you shall first attempt to resolve it through friendly negotiations; if negotiations fail, you agree to submit the dispute or controversy to the people's court with jurisdiction in the place of signing of this Agreement.

14.4 If any clause of this Agreement is partially invalid or unenforceable for any reason, the remaining clauses shall remain valid, binding on both parties, and shall continue to be performed.

XV. Miscellaneous

15.1 Once you register or use any service under this Agreement, it shall be deemed that you have read and agreed to be bound by this Agreement and the foregoing content. Tencent has the right to modify this Agreement or the foregoing content as necessary. If you continue to use this Service after the relevant content is changed, it shall be deemed that you have accepted the amended Agreement.

15.2 The titles of all clauses in this Agreement are for ease of reading only and do not have any actual meaning themselves, nor can they serve as the basis for interpreting the meaning of this Agreement.

15.3 This Agreement is drafted and interpreted in Chinese. Unless otherwise agreed by both parties, any translation of this Agreement shall not be used as the basis for interpreting this Agreement or determining the intentions of the parties. (End of document)
